The City of Wyndham has specific regulations regarding tree removal that property owners must understand before commencing any work. According to the Wyndham Planning Scheme, native vegetation is defined as plants that are indigenous to Victoria, including trees, shrubs, herbs and grasses.
A planning permit is typically required to remove, destroy, trim or prune native vegetation, including dead vegetation. This protection exists under Clause 52.17 Native Vegetation of the Wyndham Planning Scheme.
However, there are exemptions. For example, a permit is not required to remove, destroy, trim or prune native vegetation on a lot less than 4,000 square metres (or 0.4 hectares), provided the land title does not include any restrictions with tree protection controls.
It’s also important to note that trees on council land are protected under the Community Amenity Local Law 2023. It is an offence to cut, fell, poison, damage, kill or remove a tree on council land without prior consent from Wyndham City Council.
Wyndham Council is also developing a Significant Tree Register that will ultimately protect specific trees of scientific, social, historic and amenity value through planning controls. Once implemented, permits will be required to remove or carry out major works on any tree listed within this register.
