Understanding Moonee Valley’s Tree Protection Local Law
The City of Moonee Valley introduced comprehensive Tree and Canopy Protection Guidelines in July 2018 to preserve the municipality’s valuable urban forest. These guidelines regulate the removal and pruning of private trees, particularly those classified as canopy trees or significant trees.
What is a Canopy Tree?
Under Moonee Valley’s local law, a canopy tree is defined as a tree that meets the following criteria:
- Has a total trunk circumference of 1.1 metres or more, measured at 1.5 metres above ground level; or
- Has multiple stems measuring a combined circumference of 1.1 metres or more, measured at 1.5 metres along the trunks’ lengths from the closest points above ground level
What is a Significant Tree?
Significant trees are those listed on the Moonee Valley Significant Tree Register due to their value to the community. These trees may have scientific, social, historic, or aesthetic significance and receive special protection under the Environmental Significance Overlay.
When Do You Need a Permit?
A permit is required to:
- Remove, prune, damage, kill or destroy a significant tree
- Remove a canopy tree
- Prune branches greater than 10cm in diameter from a canopy tree
- Carry out any works within the tree protection zone of a significant tree
Exemptions
You may not require a permit for:
- Pruning for maintenance purposes where the branch size is no greater than 10cm in diameter and the total amount removed is not more than 10% of the canopy
- Removal of vegetation that presents an immediate risk of personal injury or damage to property
- Trees that are not classified as canopy or significant trees
Why You Need a Moonee Valley Council Permit
Obtaining the proper permits before undertaking tree work is essential for several reasons:
Legal Compliance
Removing or pruning protected trees without a permit can result in significant fines and legal penalties. Council takes tree protection seriously and actively enforces these regulations.
Environmental Protection
Trees provide essential ecosystem services including carbon sequestration, habitat for wildlife, and mitigation of the urban heat island effect. The permit process ensures these benefits are considered.
Property Values
Mature trees contribute to property values and neighbourhood aesthetics. The permit system helps maintain the character and amenity of Moonee Valley suburbs.
Community Benefit
Many trees in Moonee Valley hold cultural and historical significance. Permits ensure that community interests are balanced with private property rights.
